Welcome to the official web site (the “Site”) of Vervemail®, LLC (“Vervemail”, “we”, “us” or “our”).

Please note the distinction between our privacy practices in connection with your visit to the Site, and our business services. Vervemail is a full-service advertising agency that provides our clients with the ability to create and maintain every facet of their organization’s online advertising, including traditional advertising as well as other digital services and technologies, such as web development, text messaging and social media, under one roof (collectively “Services”).

This Privacy Policy, and as amended from time to time (“Privacy Policy”), outlines our practices, and the practices of any of our affiliates who link to this Privacy Policy, for online collection, use, and disclosure of your information that you provide to us when you use our Site as well as data that we collect through our Services.

By using this Site, you agree that your use of the Site is governed by this Privacy Policy and our Terms of Service. From time to time, we may update this Privacy Policy. We encourage you to periodically check this Site for updates. See below for information about opting out of targeted advertising and similar uses of personal information.

If you reside in certain states, like California, Virginia, Texas, or Colorado, please also see the  “State Privacy Rights” Section of this Privacy Policy.

2. Personal Information We Collect and How We Collect It

A. Information You Provide to Us: We may collect personal information you voluntarily provide to us, including your name, e-mail address, postal address, phone number, mobile number and geographic location. You may provide this information when you request information, register, make a purchase or for other purposes. We may also collect demographic information such as gender, date of birth, occupation, employer name and zip code. In limited circumstances, we may collect payment information such as credit card number where needed to complete a requested service or transaction. By requesting information to your mobile phone, we may obtain the following information from you in connection with our SMS service: your cell phone number, your carrier’s name, and the date, time and content of your messages, as well as other information that you provide. We will use such information in accordance with this Privacy Policy.

B. Automatically Generated Information: Vervemail and our third-party service providers may also collect information that is generated automatically while you are visiting the Site, other websites, mobile websites and/or mobile applications or elsewhere on the Internet in order to provide content and advertisements about goods and services of interest to you across those various devices. This data includes, but is not limited to, information such as IP address, web pages visited before and after visiting the Site, date and time, domain type, type of mobile device you use, your device’s unique ID, web pages you view and links you click on within the Site and interactions with an advertisement delivered by us or a third party advertising technology vendor. This type of information may be collected using different types of technologies, such as cookies and pixels. An IP address, for example, is a unique identifier that certain electronic devices use to identify and communicate with each other on the Internet. When you visit our Site, we may view the IP address of the device you use to connect to the Internet. We use this information to determine the general physical location of the device and understand from what regions of the world our Site visitors come. We also may use your automatically generated information to enhance our Site.

You may elect not to allow us to collect and use this automatically generated data as part of our Service by following the opt-out procedures described below.

3. Cookies and Other Technologies

A. Overview: We may use cookies and other technologies to obtain certain types of information across various devices when your web browser accesses the Site, other websites, mobile websites, advertisements, mobile applications or visits a web site in our network. “Cookies” are small pieces of information that are stored by your browser. In some cases, we may also use another company to operate web servers or process credit card purchases for our Site. The Site may use cookies and other technology to speed navigation and keep track of items and to gather anonymous traffic data that we may use to enhance the Site, our Services, marketing, and other internal purposes.

B. Remember me: If you select “remember me” on your computer when logging on to the Site, Vervemail will set a persistent cookie to retrieve your username and password when you return to the site so that you do not have to enter it more than once. It also allows us to send confirmations, receipts, updates, alerts and support and administrative messages and otherwise facilitate your use of and our administration and operation of the Site. The persistent cookie also enables Vervemail to track and target the interests of users to enhance the experience on the Site. The persistent cookie is removed when you uncheck the “remember me” check box.

C. Google Analytics: This website uses Google Analytics to help analyze how users use the site, which uses cookies. Cookies are used to collect standard Internet log information and visitor behavior information in an anonymous form. The information generated by the cookie about your use of the website (including IP address) is transmitted to Google. This information is then used to evaluate visitors’ use of the website and to compile statistical reports on website activity for Vervemail. Google Analytics collects information anonymously. Google will not associate your IP address with any other data held by Google. Neither Vervemail nor Google will link, or seek to link, an IP address with the identity of a computer user. We will not associate any data gathered from this site with any Personally Identifiable Information from any source, unless you explicitly submit that information via a fill-in form on our website. It reports website trends without identifying individual visitors. You can opt out of Google Analytics without affecting how you visit our site – for more information on opting out of being tracked by Google Analytics across all websites you use, visit this Google page http://www.google.com/intl/en/policies/privacy/.

D. Disabling Cookies: The “Help” portion of the toolbar on most browsers will tell you how to prevent your browser from accepting cookies, how to have the browser notify you when you receive cookies, and how to disable cookies altogether. Note that if you reject or block cookies, it may affect your ability to enjoy the full functionality and experience of our Site.

E. Web Beacons: Pages of our Site and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Vervemail, for example, to count users who have visited those pages or [opened an e-mail] and for other related web site statistics (for example, recording the popularity of certain web site content and verifying system and server integrity).

F. Third-Party Use of Cookies: We use cookies to compile automatically-generated data about Site traffic and Site interaction so that we can offer better Site experiences and tools in the future. We may also share aggregate non-personally identifiable information with companies such as advertisers, agencies, ad networks, or exchanges to enable them to analyze user behaviors or to customize the ads that you encounter.

G. Website Analytics – Heat Maps: We use third party providers to compile and visualize reports about how users interact with our Site. Those providers create an anonymized “heat map,” which shows which areas of our Sites are visited, read, or clicked on the most. The heat map allows us to determine which areas of our Site are most useful and popular to our visitors, and to seek feedback from visitors so that we can best ensure we’re meeting their needs.

4. Opt-out

We, along with our third-party service providers, may use automatically generated information to provide more relevant advertising and content. 5. Use of Personal Information

A. We will use your personal information for the purposes described where it is collected or as otherwise described in this Privacy Policy, including to:

  • Provide our customers with Services and any other information, products, or services that you request from us.
  • Fulfill any other purpose for which you provide it.
  • Security and fraud prevention.
  • Develop our businesses and services.
  • Internal business operations; to process.
  • Evaluate and respond to requests and inquiries.
  • Conduct marketing activities, including generating leads determining and managing the effectiveness of our own and our customers’ advertising and marketing campaigns.
  • Monitor and enforce compliance with our terms; and/or any other purposes for which you provided the information.
  • Comply with applicable legal requirements, court orders, law enforcement. government or regulatory agencies or governmental agencies.

B. Other Uses of Information: We may use certain information that may not be directly identifying (like IP address) as part of the Services to better tailor advertisements and other content in an effort to create a more relevant experience for each person that visits the Site or elsewhere on the Internet. This information may also be used to predict responses to advertisements, to help determine which ads perform best and which content is most appropriate for different individuals, to measure and optimize the effectiveness of advertisements, and to provide aggregate reporting to advertisers and clients and for our and their internal purposes. We use various web site analytics tools and technologies regarding activities on our Site that require storage of web session data. The overall aim of these tools is to aid in making our Site easy to use, to proactively identify and correct error conditions and to provide more relevant advertising and content to you. These tools and technologies are also used to assist Site visitors who report problems in the use of our Site. Stored web session data is used in accordance with this Privacy Policy.

6. Contests, Sweepstakes and Other Promotions

A. On our Site, you may wish to participate in contests, sweepstakes, and other promotions that we may offer from time to time. Through these promotions, you may choose to participate in activities such as sharing information found on our Site with others and sending e-mail invitations. In connection with any contests, sweepstakes, and other promotions that we may offer from time to time via our Site, we use the information you provide to administer the contests, sweepstakes and other promotions. Subject to applicable contractual or legal restrictions, we also may use the information to communicate with you, or the other people you select, about our or our clients’ products and services or our partners may use such information to communicate with you about the contests, sweepstakes or other promotions or their products and services. If you choose to participate in these promotions, and are eligible to do so, we may ask you for information such as your name, e-mail address, date of birth and telephone number.

7. Disclosure of Your Information

A. We may disclose aggregated and/or deidentified information that does not constitute personal information about our users without restriction.

B. In addition, we may disclose personal information that we collect or that you provide:

  • To our subsidiaries and affiliates.
  • To contractors, service providers, and other third parties we use to support our business.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information held by us about the Service users is among the assets transferred.
  • If you authorize us to do so.
  • If it is necessary in order to provide our products or services, or our clients’ products or services, to you (and contacting you when necessary for marketing purposes or other communications related to our business). That said, we don’t share marketing segments or similar lists of personal information with our clients, even, if we use such information to provide our services.
  • If it is necessary in connection with other business purposes including, without limitation, responding to your inquiries or requests for information or services, customer care, service quality, business management and operation, risk assessment, security, fraud and crime prevention/detection, monitoring, research and analysis, marketing, customer purchasing preferences and trends, dispute resolution, credit checking and debt collection.
  •  If it is necessary to disclose in order to protect or defend our rights or property or those of our users.
  •  If it is necessary to disclose in order to protect the personal safety of our users or the public.
  • If it is necessary for us to provide it to our attorneys, accountants, regulators, auditors or other advisors.

8. Third Party Features

A. Third Party Links: For your convenience, we may include or offer third party offers, products or services on our Site. Third party vendors may use cookies or other technologies to serve ads on other web sites based on your visit to this Site and other web sites on the Internet. We cannot be responsible for the privacy practices of any web sites or pages not under our control and we do not endorse any of these web sites or pages, the services or products described or offered on such sites or pages, or any of the content contained on those sites or pages. Nonetheless, we seek to protect the integrity of our Site and welcome any feedback about these web sites.

B. Social Media Plug-ins, Platforms and Web sites: When applicable, we integrate social media application program interfaces or plug-ins (“Plug-ins”) from social networks, including Facebook, Twitter, Instagram, Pinterest and possibly others on our Site. Plug-ins may transfer information about you to the Plug-in’s respective platform without action by you. This information may include your platform user identification number, which website you are on, and more. Plug-ins are controlled by the respective platform’s privacy policy. Any information, communications, or material of any type or nature that you submit to our Site (including, but not limited to any of our pages contained on a social media platform or web site such as Facebook or Twitter) by e-mail, posting, messaging, uploading, downloading, or otherwise (collectively, a “Submission”), is done at your own risk and without any expectation of privacy.

We cannot control the actions of other users of any social media platform or web site and we are therefore not responsible for any content or Submissions contained on such sites and platforms. By visiting any of our pages or web sites that are contained on a social media platform or web site, you are representing and warranting to us that you have reviewed the applicable privacy policy and terms of use of such platform or web site and that you will abide by all such provisions contained therein. Additionally, in the event that we offer a message board or any other interactive or social-type feature on a web site administered directly by us, please be aware that these areas may allow you to publicly post, and share with other users, certain messages, content, or other information (e.g., stories, pictures, ingredients, tips, etc.). Although we may take certain precautions to protect those who use these areas of one of our web sites, we encourage you to be wary of giving out any personal information in such public forums. The information you post can be collected and used by people you don’t know. We cannot guarantee the privacy and safety of these areas and are therefore not responsible for any information you choose to post. Your use of these features is fully at your own risk.

9. Email Signups

A. E-mail: We appreciate your questions and comments about our Site and Services and welcome your e-mails and questions submitted to our Site. We will share your messages with those within our organization who are most capable of addressing the issues contained in your message. We may archive your message for a certain period of time or discard it, but your e-mail address and message will only be used in accordance with this Privacy Policy.

B. Submitting your e-mail: Submitting your address anywhere on the Site may result in your e-mail address being added to the Vervemail e-mail list. You may unsubscribe to Vervemail e-mails at any time by opting out of e-mail subscriptions with the “unsubscribe” link included in each e-mail. Your e-mail address will be removed from our marketing list. Please allow us a reasonable period of time in order to satisfy your request, as some promotions may already be in process.

C. Suggesting the Site to a Friend: If you elect to use any feature that includes suggesting a page to a friend or to inform a friend about the Site or solicit donations or pledges or otherwise communicate, Vervemail may ask for your friend’s name and e-mail address. The Site may automatically send the friend a one-time e-mail inviting them to visit the Sites or otherwise provide the information requested by you. Vervemail will store and use this information in accordance with this Privacy Policy. Your friend may contact Vervemail to request the removal of this information from our databases.

10. Security

A. We employ and maintain technology and security measures designed to protect your personal information. However, no data transmission over the Internet can be guaranteed as 100% secure. As a result, while we strive to protect your information, we cannot ensure or warrant the security of any information you transmit to us or receive from us.

11. Digital Advertising Alliance

A. This Site adheres to the Digital Advertising Alliance’s (“DAA”) Self-Regulatory Principles for Online Behavioral Advertising, which administers a program to help inform consumers about data collection and advertising practices and provides consumers a means to exercise choice with respect to certain advertising practices of participating companies. 12. State Privacy Rights

A. Notice of Right to Opt-out of Sale and Sharing Personal Information and Targeted Advertising: We may allow certain third parties (such as online advertising services) to collect your personal information via automated technologies. Under certain U.S. state privacy laws, this may constitute a “sale” or “share” of personal information or “targeted advertising.” We may have “sold” or “shared” personal information, which consists of identifiers, commercial information, and internet or other electronic network activity information to data analytics providers, advertisers, and social networks for the business and commercial purposes of online advertising and to provide third-party social network features and functionality. Under certain U.S. state privacy laws, you have the right to opt-out of this disclosure of your information, which may be considered a “sale”, “sharing”, or “targeted advertising” under such laws. B. California Residents

i. Direct Marketing. California Civil Code Section 1798.83 permits users of the Services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. ii. CCPA. This portion of our Privacy Policy describes specific rights under the California Consumer Privacy Act as amended by the California Privacy Rights Act  (“CCPA”).

iii. Categories of Personal Information Collected About You. We may have collected the following categories of personal information from you withing the past twelve (12) months:

  • Identifiers such as name, address, online identifier, internet protocol address, e-mail address;
  • Additional personal information as described in California Civil Code Section 17980.80, such as telephone number, credit card number, debit card number or any other financial information;
  • Internet of other electronic network activity information;
  • Donation history and interest categories;
  • Commercial information, such as products or services purchased.

iv. Categories of Sources from Which Personal Information is Collected. We may have collected personal information about you from the following categories of sources: (1) directly from you via the Services; (2) your devices; (3) our affiliates; (4) our third-party providers; (5) other available sources, such as public records.

v. Business or Commercial Purpose for Collecting Personal Information from Consumers. The business or commercial purposes for collecting your personal information are set forth in the “Use of Personal Information” section above.

vi. Categories of Personal Information “Sold” or “Shared” to Third Parties and the Business and Commercial Purposes. The categories of personal information that we have “sold” or “shared” to third parties in the last twelve (12) months and the business and commercial purposes for “selling” or “sharing” such personal information are set forth in the “Notice of Right to Opt-out of Sale and Sharing Personal Information and Targeting Advertising” Section of this Privacy Policy. We do not knowingly “sell” or “share” the personal information of individuals under sixteen (16) years of age.

vii. Personal Information Retention. We retain the personal information that we collect to achieve the purposes for which the personal information was collected. In certain cases, we may need to retain personal information for purposes required under applicable law for tax, accounting, or audit purposes, or for other purposes permitted or required by law.

viii. Use and Disclosure of Sensitive Information. We do not use or disclose sensitive personal information, i.e., information about your religious beliefs.

ix. Your California Privacy Rights. As a California resident, you have the following rights regarding your personal information:

  • Right to Deletion of Personal Data. California residents have the right to request the deletion of personal data as prescribed in Section 1798.105(a) of the CCPA. We may not delete some or all requested personal data as required or allowed by applicable law.
  • Right of Access: This is the right to request disclosure of data collection and sharing practices
  • Right to Know. You may request to receive details about how we collect, use, and share your personal data. You may request to receive the specific pieces of personal data that we have collected about you.
  • Right to Correct Inaccurate Personal Information: The right to correct inaccurate personal information that we maintain about you.
  • Right to Opt-Out of Sale or Share: Your rights as described in the “Notice of Right to Opt-out of Sale and Sharing Personal Information and Targeted Advertising” Section of this Privacy Policy.
  • Right to Not Receive Discriminatory Treatment: We do not discriminate against you for exercising any CCPA rights, such as the access and deletion rights described above. If we choose to offer a product enhancement or financial incentive that is contingent on you sharing personal data, we will ensure that the value provided to us by that collection is reasonably related to the value of the product enhancement or financial incentive.

We will respond to such requests for information access within 30 days following receipt at the e-mail or mailing address stated above. Please note that we are only required to respond to each customer once per calendar year.

C. Other States

This portion of our Privacy Policy described the rights that may be available to you if you reside in certain states, like Colorado, Connecticut, Texas or Virginia. Please be aware that some of these rights may not apply until July 1, 2024.

If you reside in either of these states, you have the following rights regarding your personal data:

  • Right to Know and Access: The rights to confirm whether we are processing your personal data and to access such personal data.
  • Right to Correct: The right to correct inaccuracies in your personal data, taking into account the nature of the personal data and our purposes of the processing of such personal data.
  • Right to Delete: The right to delete personal data provide by or obtained about you.
  • Right to Obtain a Copy: The right to obtain a copy of your personal data that you previously provided to us in a portable and to the technically feasible, readily useable format that allows you to transmit to the data to another controller without hindrance, where the processing is carried out by automated means.
  • Right to Opt-Out: The right to opt out of the processing of your personal data for purposes of: (1) targeted advertising, (2) the sale of personal data, or (3) profiling in furtherance of decisions that product legal or similarly significant effects concerning you. Note, however, that we do not engage in (3), so that right does not apply.

Please note that we will seek to verify your identity when we receive an individual rights request from you in order to ensure the security of your information. We may need to collect information such as your name, email or transaction history in order to verify your identity. If you designate an authorized agent to make a request on your behalf, your authorized agent need to provide similar information for verification. If we refuse to take action upon your request, you may appeal such refusal by contacting us after your receipt of the refusal at [email protected].

13. Do Not Track

Like many other websites and online services, Vervemail does not currently alter its practices when it receives Do Not Track signals. To find out more about “Do Not Track,” you may wish to visit http://www.allaboutdnt.com.

14. Children

Our Services that collect personal information are not intended for children of age, and we do not knowingly collect personal information from individuals under 18. If we learn we have collected or received personal information from an individual under 18 without verification of parental consent, we will delete that information. If you believe we might have any information from or about an individual under 18, please contact us.

15. Special Statement for Job Applicants

Any personal information that you provide to us when applying for a career position with Vervemail will be used solely to consider and act upon your application. We may retain your personal information for a period of time, but only for as long as necessary for such purposes or as otherwise required or permitted by law. We may disclose your personal information to our agents for the purpose of evaluating your qualifications for the particular position you applied for, for other available positions or as otherwise required by law. We may also disclose your personal information to third parties hired by us to collect, maintain, and analyze candidates for career positions or as otherwise required by law.

16. Visiting Our Site from Outside of the United States

If you are visiting our Site from outside of the United States of America, please be aware that your information may be transferred to, stored or processed in the United States, where our servers are located and our central database is operated. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country, but please be assured that we take steps to protect your privacy. By using our Site, you understand that your information may be transferred to our facilities and those third parties with whom we share it as described in this Privacy Policy.
